Norfolk Southern shareholders on Thursday voted to elect three of dissident Ancora's director nominees but fell short of ousting incumbent CEO Alan Shaw. Norfolk Southern's board had fought hard to stave off Ancora's biggest demand: firing current CEO Alan Shaw. The activist had argued that Norfolk Southern should adopt a model known as precision-scheduled railroading, or PSR, which has delivered impressive shareholder returns at other railroads. Government officials, who had previously voiced their support for Norfolk over Ancora, were momentarily silenced by the reversal. ISS recommended that shareholders support five of Ancora's seven picks but did not recommend electing Ancora CEO pick Jim Barber to the board.

Opinion | Congestion Pricing and Confusion

To the Editor:Re “M.T.A.’s Congestion Fees Will Launch on June 30” (news article, April 27):Any congestion pricing plan must be implemented responsibly, with full consideration of its effects on vulnerable communities and the environment. Drive, concentrated in an area with many low-income residents that is already designated as an Environmental Justice Area by New York State, is deeply concerning. If this plan is to be truly transformative, its effects must be thoroughly studied and mitigated. The M.T.A.’s resistance to a proper environmental impact study and its urgency in pushing this plan forward are alarming. Rushing forward without proper due diligence is irresponsible and risks irreparable harm to already vulnerable communities.

Here's what to expect from the April jobs report on Friday

Allison Joyce | Bloomberg | Getty ImagesHiring likely continued at a brisk pace in April as investors look for any cracks in the labor market that could sway the Federal Reserve. If that top-line number is accurate, it actually would reflect a small step back from the average 276,000 jobs a month created so far in 2024. April's jobs market featured more strength in health care and leisure and hospitality, Glaser added. Beating expectationsIndeed, the labor market has been full of surprises this year, topping Wall Street estimates at a time when many economists expected hiring to have slowed down. "The Goldilocks scenario is an unemployment rate rise with a participation rate rise," Matus said.

Activist investor Ancora received a powerful endorsement in its efforts to secure a board change and to oust Norfolk Southern CEO Alan Shaw on Monday, when proxy advisor Glass Lewis recommended the railroad's shareholders vote for 6 of Ancora's board nominees. "We believe Ancora has presented a compelling case for supporting a substantial overhaul of the Company's current leadership," Glass Lewis said in its report. Furthermore, Glass Lewis said Barber, Ancora's pick for CEO, and Jamie Boychuk, the activist's pick for COO, "have compelling credentials and track records." Ancora also seeks to install former CSX executive Boychuk as Barber's chief operating officer. Their support, coupled with Glass Lewis' endorsement, gives the activist powerful ammunition as it seeks to convince shareholders.

All of this is transforming Carrier Global , the nearly 100-year-old manufacturer whose founder, Willis Carrier, invented air conditioning. Anne Neuberger, Deputy National Security Advisor for Cyber and Emerging Technology, cited President Biden's signing in February of an executive order to strengthen the cybersecurity of U.S. ports . The nation's port system is the main point of entry for trade, employs 31 million people, and generates over $5.4 trillion for the U.S. economy. One of the key areas of concern for the Biden administration and the executive order is the security of Chinese-manufactured cranes. Biden administration officials recently warned the nation's governors about the threat to water systems. Overall mortgage demand has now moved sideways for three straight weeks, but last week saw a split between those looking to buy a home and those hoping to save money with a refinance. Total mortgage application volume increased just 0.1% last week compared with the previous week, according to the Mortgage Bankers Association's seasonally adjusted index, essentially flat. "Mortgage rates moved higher last week as several Federal Reserve officials reiterated a patient posture on rate cuts. Refinance demand usually drops when rates rise, but rates had fallen back slightly in the previous weeks, so some homeowners may have been waiting for them to go even lower. It is set to be released Wednesday morning, and depending on the outcome, mortgage rates could make a strong move in either direction.

Imports coming to the U.S. from China are experiencing a notable increase, according to new trade and logistics data. The first half of 2024 is expected to total 11.7 million TEUs (twenty-foot equivalent units), an increase of 11% from the same period last year. In 2023, imports were down from 2022 by almost 13%, totaling 22.3 million TEUs. By comparison, New York/New Jersey processed 7.81 million TEUs, Georgia 5.4 million TEUs, Virginia at 3.3 million TEUs, Charleston 2.5 million TEUs, Jacksonville 1.3 million TEUs, and Miami 1.25 million TEUs. The other reason for the recent container push is fears of a labor strike at East Coast and Gulf ports.

CNN —The largest apex predator in the tropical seas, tiger sharks are notoriously fierce. But in The Bahamas, tiger sharks have taken on a rather less ferocious role, as assistants to marine scientists. The data they collected revealed what is the world’s largest known seagrass ecosystem, an area of up to 92,000 square kilometers (35,000 square miles) in the Bahamas. Tiger sharks with cameras helped scientists to map the world's largest known seagrass ecosystem. Fears about the health of the real estate market, and a confusing economic landscape, leave commercial banks questioning what comes next. The commercial real estate market is definitely under some pressure because of the rising rate environment. So I think banks are watching all that closely and working closely with regulators. How long do you think commercial real estate woes will weigh on banks? It definitely persists, and it depends on the banks’ weighting of real estate as a percentage of their portfolio.
